YORKVILLE, IL (May 16, 2024) — A Kendall County jury awards $136,200 to semi-truck driver, Jerome Pollnitz, for injuries he sustained in a crash on Highway 47 in 2017. This decision comes after the defendant’s insurance, State Farm, offered only a $40,000 settlement.
Pollnitz, the plaintiff, was heading south on Highway 47 on September 4th, 2017 when the defendant reckless crossed the highway. They proceeded to make an abrupt U-turn with complete disregard for the stop sign. Unable to stop, Pollnitz crashed into the defendants car as they entered back onto the highway.
The legal team on the case was comprised of three attorneys from Disparti Law Group including Jamaal Buchanan, Carlton Fay, and Jonel Metaj. This stand-out team fought to the very end for our client since filing the complaint back on May 29th, 2018.
After the crash, Pollnitz was taken to the hospital by ambulance with tingling sensations in his hands. This is often an indication of a possible spinal injury. Low and behold, the very next day, the plaintiff began experiencing severe pain in his neck and back.
Just a week later, an MRI revealed a disk bulge in his lower back. For 2 months, Pollnitz underwent treatment with a chiropractor. Two years went by before the pain returned and he had to restart treatment.
This time, Jerome’s treatment also required 3 injections. Ultimately, the PT and injections were not enough to resolve his pain and he received a recommendation for spinal surgery.
To no surprise, the medical expenses started piling up to the amount of $54,129. The low-ball offer of $40,000 from State Farm would have put Pollnitz out nearly $15,000 for an accident he was not at-fault for.
Time and time again, we see insurance companies doing everything possible to save themselves money at the victim’s expense. And in this case, State Farm did not believe the treatment he received 2 years later was due to the crash.
