What You Need to Know About Veterans’ Disability and Florida Law

Generally speaking, there are two types of compensation for disabled veterans, disability compensation and non-service connected pensions.

  1. Disability Compensation — Veterans who have injuries or physical or mental conditions that were caused by military service or were aggravated by active duty may qualify for disability compensation. Veterans’ disability compensation covers injuries and conditions incurred while on active duty. You do not have to have been in combat to receive disability compensation. The amount of your veteran’s disability compensation varies, depending on the degree of your injury or disability. To determine the amount of your benefit, the VA assigns you a disability rating ranging from 0 percent to 100 percent disability. A 100 percent disability rating means you have one or more serious service-related disabilities that interfere with your normal day-to-day activities. You may qualify for veterans’ disability while continuing to work. In fact, most veterans receiving disability compensation still maintain a job. There is no cap on your income to qualify for veterans’ disability compensation. Only if you have a high disability rating based in part on your unemployability would having a job be an issue.
  2. Non-Service Connected Pension — Veterans who have low incomes and were severely disabled after their military service may qualify for a non-service connected pension, also known as an improved pension, if they served during a period of war. Veterans who have both service-related conditions and non-service related disabilities and very low income may receive assistance from both programs. Proving that a veteran’s disability is related to an injury or illness connected to their military service is the most challenging part of obtaining a veterans’ disability compensation. Certain conditions — such as Agent Orange and herbicide exposure — are presumed to be service-related for veterans who were in theaters of war during certain periods.
