An eye care product recall has been issued for several different eyedrops and gel items produced by BRS Analytical Services, LLC, and distributed by AvKARE.
The Food & Drug Administration (FDA) issued its second-highest recall warning for more than 70,000 eye care products nationwide for a “lack of assurance of sterility.”
What to Know
On May 6, the FDA issued a Class II recall, a category reserved for situations in which “there is a reasonable probability that the use of or exposure to a violative product will cause serious adverse health consequences or death.”
The eye solutions were shipped between May 26, 2023, to April 21, 2025.

Chicago Medical Malpractice FAQs
Can I Sue For Medical Malpractice If A Doctor Makes A Mistake?
Yes. If a doctor’s mistake leads to harm, you may have a medical malpractice claim. Not every error qualifies, but when negligence causes injury, such as failing to diagnose, prescribing the wrong medication, or performing a procedure incorrectly, you may be entitled to compensation. Speaking with an experienced attorney helps determine if your situation meets the legal standard for malpractice.
How Long Do I Have To File A Medical Malpractice Claim In Illinois?
Yes, there is a deadline. In Illinois, most medical malpractice lawsuits must be filed within two years of when the injury was discovered, or reasonably should have been discovered. There is also a four-year statute of repose, which bars claims more than four years after the malpractice occurred. Missing these deadlines usually means losing your right to file. An attorney can review your case and explain your timeline.
Do I Need An Attorney To File A Medical Malpractice Claim?
Yes. While you can technically file without an attorney, malpractice law is highly nuanced. Hospitals and insurance companies often have legal teams ready to defend against claims. Having a lawyer means having someone to gather medical evidence, consult with professional witnesses, and fight for fair compensation. The Disparti Law Group Accident & Injury Lawyers has handled these cases with proven results and may guide you through each step.
What Compensation Can I Receive In A Medical Malpractice Case?
Yes, financial compensation is possible. Victims may recover damages for medical bills, lost wages, ongoing treatment, and pain and suffering. In severe cases, compensation can include long-term care costs or wrongful death damages for families. Each case is unique, so the exact recovery depends on the impact of the negligence. A qualified attorney can calculate what your claim may be worth.
Can Recalled Medical Products Lead To A Malpractice Claim?
Yes. If a recalled medical product, such as faulty eye drops or defective surgical tools, causes harm, it may create both a malpractice and a product liability claim. Recently, the FDA recalled thousands of eye care solutions due to sterility concerns. Patients who were injured after using these recalled products may qualify for legal action. Attorneys can help determine whether the provider, manufacturer, or distributor should be held responsible.
