Florida’s Wrongful Death Law  

Under Florida Wrongful Death Act, “survivors” of the deceased have the right to bring a legal action when their loved one’s death is caused by the “wrongful act, negligence, default, or breach of contract or warranty of any person, including those occurring on navigable waters.” Eligible survivors include the decedent’s spouse, minor children, parents and, “when partly or wholly dependent on the decedent for financial support or services,” any blood relatives and adoptive brothers and sisters. “Minor children” are children younger than 25 years old, including adopted children. Compensation recovered in a wrongful death lawsuit may include:

  • Lost earnings (of the decedent)
  • Lost support and services (including future losses)
  • Loss of companionship and protection (for the spouse)
  • Mental pain and suffering
  • Loss of parental companionship, instruction and guidance
